LONDON INTERNATIONAL DISPUTES WEEK

Erskine Chambers is pleased to be involved in the London International Dispute Resolution Week 2024, which will take place from Monday 3 June – Friday 7 June.

LIDW brings together all professionals in London’s dispute resolution community. The week consists of various events and seminars in which key topics and issues are discussed.

Our members of chambers will be involved in the following events :

Shareholder disputes – contentious exits and the international dimension –  Thursday 6 June 2024 from 11:00 – 12:30

On 6 June, as part of LIDW, Andrew Thompson KC is presenting a session on “shareholder disputes – contentious exits and the international dimension” with Kate Allass of Farrer & Co and James Worsnip of Alix Partners. Although long sold out, more capacity is being made available. This wide-ranging session will deal with the contentious implementation of various common contractual exit mechanisms, as well as different possible exits purely through litigation and arbitration, for both companies and LLPs, domestic and cross-border.

Which way out? A new wave of shareholder, transaction and joint venture disputes, driven by recent market and valuation trends  –  Thursday 6 June 2024 from 16:00 – 17:30

Various financial and economic trends (inflation, interest rates ‘higher for longer’, valuations) are affecting deal dynamics and prompting parties, particularly PE investors, to question original investment plans and ask whether an alternative exit is available. In order to maximise value, rights in shareholder agreements and SPAs are exercised and disputes triggered which were unlikely to have been considered at the outset of the deal.

James Potts KC will join Tim Browning (Eversheds Sutherland) , Phillip Richardson (Eversheds Sutherland), Alex Davie (FTI Consulting), and Nicola Lancaster (Shell International Limited) to examine the underlying trends, explore the typical rights that are being exercised and ways in which these disputes are being litigated and resolved.
